APPSC Paper Leak Case
It is noted the Gauhati High Court’s Itanagar bench approved his bail. However, he is still in custody. Significantly, no chargesheet had been submitted within 90 days of the case’s filing.
In this regard, the Court stated, ”The present accused was entitled to default bail under Section 167(2) CRPC because the case’s investigating officer had neglected to provide the chargesheet. The CBI was unable to submit a written objection.”
“It is clear that the investigating authority has not objected either, despite the fact that it was given time. The CBI may have started looking into the case in early January, but the fact that the accused has been lingering in jail custody for the past 98 days without providing the chargesheet is still true”, the Court further added.
